Terms of Services for Elderfit Group LLC

1. Service Description
ElderFit Group LLC provides a marketplace website application platform to connect senior users with fitness trainers who visit their homes for personal training sessions. The website application includes features such as scheduling, workout tracking, and fitness advice. As part of acceptance of ElderFIT’s terms and conditions, the customer and senior user, whether separate or one in the same, agrees to allow ElderFIT and its contract trainers to use the calendar-based booking functionality to schedule upcoming workout sessions (applies to both in-person and online virtual training sessions) on behalf of the customer and/or senior user to allow for a more efficient and easy booking process; the customer may also schedule upcoming workout sessions rather than rely upon the trainer; all scheduled booking sessions will be in the future and the customer and/or senior user will be notified by text and email about the date, time, location and price of the scheduled session. The customer and/or senior user will have the ability to review any upcoming scheduled sessions, ask questions directly to the trainer and/or ElderFIT team, request a different date/time/location for a scheduled session, and also cancel the session. Once a session occurs and the trainer fulfills the required training instruction, the trainer will ‘complete’ the session, resulting in a payment for the session based on the initial authorization performed against the customer’s credit card they added to their account upon setting it up. If there is a payment dispute, the customer must do so promptly or no later than 15 days after the payment processes by contacting ElderFIT either by phone or email.
2. User Eligibility
The services are intended for customers seeking the help of personal fitness trainers for themselves or their relatives or an interested party. Users must be of the legal age determined by their jurisdiction to use our services. Users should consult with a healthcare professional before beginning any new exercise regimen.
3. Trainer Qualifications
All trainers are independent contractors who have undergone a vetting process, including but not limited to professional trainer certification verification.
4. User Responsibilities
Customers and senior users of ElderFIT are responsible for providing a safe environment for in-home training for both the seniors and their trainers. Customers and/or senior users must inform trainers of any health issues, physical limitations, or specific needs prior to training sessions. All customers and/or the senior user is responsible for tracking their upcoming scheduled workout sessions and reviewing past sessions to ensure they are accurate from a session completion and payment perspective.
5. Cancellation
Customers and senior users of ElderFIT are responsible for fulfilling their scheduling commitments made with ElderFIT trainers using the ElderFIT platform. You are welcome to cancel any visit. However, if you cancel the day of your visit, we require that you notify your trainer via ElderFIT chat. The cancellation must be done using the ElderFIT platform by ‘declining’ the session. ElderFIT has a clear cancellation policy to make things fair for both seniors and trainers:
- More than 12 hours before the session start time: No charge.
- Less than 12 hours before the session start time: 100% of the session fee is charged.

6. Limitation of Liability
ElderFit Group LLC is not liable for any injuries, health problems, or damages resulting from the use of our website app or services provided by personal trainers operating as independent contractors of ElderFIT. While we strive to ensure the quality and suitability of trainers, we are not liable for their actions or omissions. All contract trainers hold current professional liability insurance with single incident levels of one million dollars or greater per incident.
7. Indemnification
Users agree to indemnify and hold harmless ElderFit Group LLC, its officers, directors, employees, and agents from any claims, damages, injuries, or expenses arising from the use of the ElderFIT website application or services.
8. Text Messaging and other Contacts
You expressly consent to us contacting you using written, electronic, or verbal means, including by email at the email address you provided to us and by telephone (including pre-recorded calls, voice messages, or by using an automatic telephone dialing system) at the mobile number(s) you provided to us: (a) as necessary to complete transactions requested by you and as the law allows, (b) to provide the Service or service your User Account, or (c) to enforce these Terms, our policies, applicable law, or any other agreement we may have with you. You also consent to allowing ElderFIT, or its contract trainers through the use of the ElderFIT website application, to schedule workout sessions (either in-person at the residence of a senior user or an agreed-to location such as a gym or meeting room or a virtual online session) to use text messaging and emails to notify you of future workout sessions agreed between the customer and/or senior user and the ElderFIT trainer, which includes confirmation of completion of sessions; all emails and texts include links informing customers and senior users that they can check on the status of their account on their designated ElderFIT customer dashboard.
We also offer you the chance to receive recurring promotional email and text messages from us, which may include account-related news and alerts, tips, reminders, and marketing and promotional offers for our products and services and those of our service providers. By providing your email address to us, you agree to receive promotional emails from us at that email address. By enrolling in our promotional text messaging service, you agree to receive promotional texts from us at the mobile number(s) you provided in the amount and frequency set forth in the confirmation text we send you. You certify that the mobile number you provided is true and accurate and that you are authorized to enroll that number to receive such texts. You acknowledge and agree that we may send texts using an automatic telephone dialing system and that standard message and data rates may apply. Consent to receive promotional emails or texts is not required as a condition of use of the Service. We are not responsible for any delays with respect to sending or receiving text messages.
To unsubscribe from text messages at any time, text STOP to 1-888-492-2643 or reply STOP to any text message you receive from us. You consent that following such a request to unsubscribe, you may receive one final text message from us confirming your request. 9. Modification of Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on the app and effective immediately.
10. Termination
We reserve the right to terminate your access to the app for any breach of these Terms and Conditions.
11. Governing Law
These Terms and Conditions are governed by the laws of the United States of America.
